Sometimes events happen and we find ourselves in situations that depend neither on the tour operator nor on the travelers. The reasons can be medical or non-medical. These are cases of flight cancellations, flight delays, shortening of the trip for medical or non-medical reasons, extension of the trip due to force majeure. These are force majeure circumstances over which the tour operator has no control, and all travelers are affected.

WEB TOURS Ltd. offers "Trip Cancellation" insurance, which covers these risks and adds security in the choice of a tourist service. "Trip Cancellation" insurance can be added to any reservation at the time of its conclusion. Upon the occurrence of an insured event, the Insurer reimburses the prepaid expenses for organized travel, plane tickets, hotel reservations and additional tourist services that are non-refundable by the TOUR OPERATOR. MEDICAL REASONS are: illness, accident or death of the Insured, his/her close relative or business partner. Medical reasons are also considered to be an unexpected worsening of a chronic illness of the Insured, only in the event of hospitalization, the medical indicators of which are contraindicated for starting or continuing the trip. NON-MEDICAL REASONS are: appointment of the Insured as a juror, summoning the Insured as a witness in a case or providing an expert opinion, the knowledge of which is after the date of booking; service of a notice of a divorce claim filed by a spouse; malicious acts, theft or robbery within the meaning of Art. 195, para. 1, item 3 and Art. 198, para. 1 of the Criminal Code in the Insured's residence or in premises where the Insured carries out commercial, professional or industrial activities, natural disaster, arson or fire of the same, occurring no more than 72 hours before departure or during the trip and provided that the damage to the property exceeds BGN 2,000, as well as when the presence of the Insured is required by a competent state authority in connection with such events; dismissal of the Insured; inability to depart due to adverse weather conditions; missing the next flight due to a flight delay (in the case of connecting flights); events leading to a delay or cancellation of a flight; a road accident, damage or theft of a vehicle or an accident of the vehicle used for the trip, causing an unexpected delay; theft of the Insured's documents, which are necessary for him to leave the country in case of proven physical impossibility, they must be reissued before the trip.

Effect of "Trip Cancellation" insurance in cases of canceled flights and flight delays

1. Cases of flight cancellation

Cases of flight cancellation for a specific day and time are considered force majeure. The TOUR OPERATOR is not responsible in these cases.

In cases where the airline cancels a flight for the initial departure date of an organized trip, the TOUR OPERATOR checks the possibilities for changing the date or the initially agreed route so that the change does not significantly affect the trip as a whole. If such options do not exist, the TOUR OPERATOR cancels the trip as a whole. The TOUR OPERATOR provides a document certifying the non-returnability of the funds paid by the TOURIST for the organized trip with a total price and the TOURIST files a claim with the Insurer. The "Trip Cancellation" insurance covers all proven non-refundable amounts and the Insurer pays the amounts to the TOURIST.

In the event of a cancellation of a return flight by the airline, the airline shall be responsible for the transportation and hotel accommodation of the TOURISTS, if the situation so requires. If the cancellation of a flight requires rebooking of seats for a new flight, the TOUR OPERATOR shall make the necessary changes and reserve seats for a flight on the same route, for the next possible date, if the carrier has available seats at the time of cancellation. If at the time of cancellation there are no available seats for a flight on the same route, for the first possible date, the TOUR OPERATOR reserves seats for the next closest flights on a route different from the previously agreed upon. If the re-confirmation of flights requires additional payments, they are made at the expense of the TOURIST, and the amount paid by the TOURIST is confirmed with a payment document (receipt or invoice). If the next flight date requires an additional night/nights, the TOURIST pays for an additional hotel stay, and the amount paid by the TOURIST is confirmed with a payment document (receipt or invoice). If the cancellation requires the TOURIST to move from one location to another, the TOURIST shall pay for the transportation costs. The TOURIST shall provide the Insurer with all expenses incurred as a result of the cancellation by the airline and file a claim for damages and reimbursement of expenses incurred as a result of the canceled flight.

2. Cases of flight delays

Cases of flight delays for a specific day and time are considered force majeure. The TOUR OPERATOR is not responsible in these cases.

Flight delays may lead to significant changes in the previously agreed program, for which the TOUR OPERATOR is not responsible and does not compensate the TOURIST for missed elements of the program. In these cases, the TOUR OPERATOR has the right to make changes to the itinerary, rearrange the sequence of the program and exclude, if the flight delay necessitates it, an element of the trip that it deems appropriate.
